Terms & Conditions of Sale

Any resale price or margin or conditions of sale set out or indicated herein are suggestions only. Other prices may be charged and other conditions of sale may be imposed in relation to the goods to which the price or margin or conditions of sale relate, without rise to the issuer of this notice or the supplier of the goods applying sanctions of any kind.

GOODS AND SERVICE TAX
All trade prices shown are EXCLUSIVE of GST.

ACCEPTANCE OF ORDERS
We reserve the right to accept orders, subject to:

1. Prices current at date of dispatch
2. Availability of raw materials or goods
3. The product specification may be altered without prior notice
4. The supply of goods in standard packs or minimum quantities as shown herein.
5. Corrections of errors or omissions on invoices or credits.

PAYMENT TERMS
Payment for purchases must be made by the 20^th of the month following delivery.  Supply on credit may be discontinued on overdue accounts.  If settlement of the overdue amount is not made, the debt may be passed on to an appropriate collection agency.  All collection costs including collection agency and actual solicitors’ costs will be added to the outstanding debt.  The Company reserves the right to charge interest at the rate of 1.5 % per month on any overdue portion of the account.

CREDIT CLAIMS

1. Damage and short delivery: The Customer must make a claim within FOURTEEN (14) CALENDAR DAYS of receipt of goods. The Company will refuse claims made after that time.
2. Other Credit Claims: All other credit claims must be made within FOURTEEN (14) CALENDAR DAYS of receipt of goods. Documentary evidence in support of claim must be supplied and the onus of proof is with the Customer.

OWNERSHIP OF GOODS: The risk in all goods sold passes to “The Customer” upon delivery. Ownership of all goods sold remains with the Company  until payment is made in full for those goods. The Company is authorised to enter “The Customer’s” premises and to reclaim any goods not been paid for by due date

VENDOR’S LIABILITY: The liability of the Vendor for any loss or, (including loss or damage caused by the negligence of the vendor or its servants or agents,) arising out of, or in connection with, the sale of the goods supplied, shall be limited to either replacement of the goods supplied, or at the option of the vendor, a refund of the purchase price. It is “The Customer’s” responsibility to ensure the suitability of a product purchased as being acceptable for its intended use.The Company  cannot guarantee the suitability of any product for a specific purpose.

CONSUMER GUARANTEE ACT: Where the customer has acquired goods from the Company for the purpose of a business, or has advised the company  them to be for the purpose of a business, section 5(1)(c) of the Consumer Guarantees Act (which guarantees undisturbed possession of the goods) shall not apply.

RETURN OF GOODS
Total Supply Ltd will not accept return of goods without prior approval from Total Supply Customer Services (Phone: 0800-800-668). An approval notice will then be issued, which must accompany returned goods.

Please note the following:

1. The Company will not accept return of goods without prior approval. When Total Supply Ltd gives approval for return of goods an approval notice will be supplied which must accompany the merchandise.
2. Return of goods for credit must be made within FOURTEEN (14) CALENDAR DAYS OF DELIVERY.
3. A 10% HANDLING CHARGE will be made on all returns. (Our errors excepted).
4. All returns must be made to Total Supply Ltd New Zealand and the onus of proof of return, remains with the Customer
5. Graphics self-adhesive vinyl of lengths less than 5 metres returned for credit will be credited at 50% of the total cost as invoiced. Lengths of vinyl less than 5 metres are deemed non-commercial and specialled to clear.
6. Return of freight is the Customer’s responsibility, except our errors, where we will nominate the carrier.
